Special counsel Jack Smith responded to Supreme Court Justice Clarence Thomas’ criticism of his appointment in the classified documents case in Florida. Smith emphasized that Thomas’ comments should not impact the criminal case against former President Donald Trump, stating that Thomas’ writing in the presidential immunity case is not binding on US District Judge Aileen Cannon.
Trump’s legal team brought the Supreme Court’s immunity ruling and Thomas’ concurrence to Cannon’s attention, arguing that it strengthens their case for dismissing the charges in Florida. In response, Smith agreed that both sides should provide more briefing on how the high court’s ruling affects the documents case.
Despite Trump’s claim of presidential immunity, Cannon has not indicated how she will consider the Supreme Court’s ruling. She has requested additional briefing from the parties on how the case should proceed.
The outcome of this case could have implications on all four criminal cases against Trump, as they all stem from the election subversion case against him in Washington, DC. It remains to be seen how the court will navigate these complexities.
