The federal judge overseeing the case will hold a hearing on Monday for both parties to present arguments over the proposed gag order, with tensions expected to escalate.
Prosecutors are concerned about Trump mischaracterizing the FBI’s policy on the use of deadly force during the search, leading to potential threats and harassment against agents.
Trump was in New York at the time of the search of the Florida estate.
In a filing on Friday, prosecutors cited examples of threats and violence that could result from Trump’s comments, including an armed attack on an FBI office by one of Trump’s supporters.
Trump’s attorneys argue that the gag order violates his First Amendment rights and that prosecutors have not provided evidence of agents being harassed due to his comments.
Prosecutors responded by stating that Trump cannot avoid responsibility for any violence incited by his words, and addressed claims that special counsel Jack Smith was interfering with Trump’s campaign efforts.
The Government clarified that they have no interest in matters related to Trump’s campaign and criticism of the Biden Administration, stating that Trump is free to make such comments without limitations.
