    Two Years After Roe v. Wade Overturn, Republicans Still Grappling with Abortion Policy – Impact on 2022 Elections and State Laws

    In the aftermath of the 2022 Dobbs decision and the overturning of Roe v. Wade, the issue of abortion policy continues to be a major point of contention for Republicans across the country. While some states are pushing to restrict access to the procedure, others are working to expand reproductive rights. The political implications of these developments are significant, with Democrats hoping to gain electoral ground by highlighting GOP positions on abortion.

    The Alabama Supreme Court’s ruling on embryos and the Arizona court’s revival of an 1864 abortion ban have put Republicans in competitive races in a difficult position. Many are working to distance themselves from unpopular positions, such as threats to in vitro fertilization and laws without rape and incest exceptions. The issue of abortion has also made its way to the US Supreme Court, with cases involving the abortion pill mifepristone and emergency abortions keeping the issue in the spotlight.

    As Democrats continue to use reproductive rights as a key issue in upcoming elections, polling shows that most Americans prefer some access to abortion. Despite this, Republicans like political consultant Whit Ayres argue that states should ultimately decide on abortion policy to match their cultural values. Anti-abortion groups have rejected the idea that their issue is a liability for the GOP and have called for federal action to limit access to abortion.

    States like Louisiana have already passed laws restricting abortion, and others are considering measures to further limit access to the procedure. Abortion opponents are also pursuing options at the federal level, with some conservatives looking to use the Comstock Act to ban abortion pills. The issue of abortion medication is a key point of contention, with Trump advocating for exceptions for rape, incest, and to protect the life of the mother.

    As state courts hear challenges to abortion restrictions, the role of state Supreme Court races has become more competitive. Democrats like Amanda Zurawski, who was denied an emergency abortion in Texas, have become vocal advocates for reproductive rights. The issue of abortion policy remains divisive, with both parties hoping to gain political ground by highlighting their positions on the issue.
